Professional Experience
Mr. Dunphy's litigation practice focuses on condemnation actions, construction and related risk management, and business disputes. He has represented numerous business owners whose property has been subjected to condemnation for a wide variety of projects, including public sport and entertainment facilities, high pressure natural gas pipelines, electrical transmission facilities, highways, stormwater treatment facilities, public parking garages, and light rail projects- including station locations and other right of way acquisitions by Sound Transit. Mr. Dunphy has represented a broad array of businesses in eminent domain and inverse condemnation proceedings including retailers, airport parking businesses, multifamily project owners, developers, real estate investment partnerships, homeowner communities, a funeral and memorial park association, manufacturers, and surface mine operators. Mr. Dunphy is a frequent speaker regarding eminent domain law, and participated in a rewrite of the Just Compensation section of Nichols, the leading treatise on the law of Eminent Domain (condemnation).
Mr. Dunphy has been AV rated by his peers for legal ability and ethics - Martindale-Hubbell's highest rating. Prior to joining Schwabe, Williamson & Wyatt in 1981, he served as Assistant Attorney General for the State of Montana for three years.
Mr. Dunphy has been recognized as a Washington Super Lawyer, which is an annual listing of outstanding lawyers who have attained a high degree of peer recognition and professional achievement.
Professional & Community Activities
Mr. Dunphy belongs to the Washington State Bar Sections on Public Procurement and Private Construction Law and Environmental and Land Use Law. He has served as a faculty member at numerous continuing education seminars, including the American Law Institute of the American Bar Association (Eminent Domain), Executive Enterprise's Environmental Regulation Course, and an Associated General Contractors-sponsored course on construction law. Mr. Dunphy provides volunteer legal services for low income persons through the Legal Action Center, and is a member of its Advisory Board.
