JACKSONVILLE, FL -- Lawyers for Keystone Coal Co. have developed a new case to show that the company's property being sought by eminent domain is worth several times more than the Jacksonville Port Authority says.
Keystone's lawyers have indicated an intention to relate offers by the authority for property owned by Zion Jacksonville Limited Partnership to Keystone's land's value, and to compare development costs for the two properties.
How much of Keystone's case they can present is unclear after Senior Judge Richard Watson took arguments under advisement following a March 27 pretrial hearing regarding a motion by authority lawyers to exclude evidence.
A December 2006 ruling said the taking is proper, moving the case to a 12-person jury to decide the market value of Keystone's 70 acres of industrial waterfront property at the northern terminus of Talleyrand Avenue. The parties are scheduled for trial April 21 to determine what the authority must pay to complete the taking.
