In its Kelo decision the Supreme Court ruled that private property could be taken by government under the power of eminent domain and given to a private developer in the name of economic development. In response to Kelo, many states have passed legislation to curb eminent domain abuse. However, some states have yet to pass substantive reforms or any legislative reform at all.
