Missoula Files Condemnation Suit to Take Privately-held Mountain Water Hoping the Second Time Will be the Charm

Last week the City of Missoula, Montana filed suit in District Court seeking “a judicial determination entitling it to acquire by eminent domain Missoula’s privately-owned water supply and distribution system” – Mountain Water Company. The City has sought to purchase the utility from its parent company, the Carlyle Group for some time, however, the City’s most recent offer of $50 million and previous offer of $65 million were both rejected.

Montana Legislature May Repeal 2011 Law Giving Private Utility Companies Eminent Domain Powers

Last week the Montana Senate passed a bill repealing a 2011 law that provided the power of eminent domain to private utility companies constructing merchant transmission lines. Senate Bill 180, sponsored by Senator Debby Barrett (Rep.), passed the Senate with a vote of 28-22 and was sent to the House on February 27.

Montana’s eminent domain bill HB 198 becomes law without Governor’s amendment

On Thursday, May 12, Montana Governor Brian Schweitzer allowed Montana House Bill 198 (HB 198) concerning eminent domain to become law. Despite the imbalanced aspects within HB 198 favoring big business over landowners’ rights, Gov. Schweitzer chose to not veto the bill allowing it to become law.
